On additional measures to improve the efficiency of fruit and vegetable promotion to foreign markets 18.10.2018 14:39

In order to expand the export potential of the country, eliminate barriers to the full development of the export of fruits and vegetables, improve state support for export activities, and create a comprehensive system for promoting domestic fruits and vegetables to foreign markets:

1. To accept the proposals of the General Prosecutor's Office, the Commissioner under the President of Uzbekistan for the protection of the rights and legitimate interests of business entities, the Ministry of Foreign Trade, the Ministry of Economy and the Ministry of Agriculture of the Republic of Uzbekistan on determining the procedure in accordance with which:

legal entities - exporters of fruits and vegetables have the right to export fruits and vegetables without prior payment, opening a letter of credit, issuing a bank guarantee and having a policy to insure an export contract against political and commercial risks;

business entities have the right to export fruit and vegetable products without a license for wholesale trade. At the same time, the procedure for taxation, providing for the payment of a single tax payment, is applied to the revenue of individual entrepreneurs received from the export of fruits and vegetables;

exported fruit and vegetable products are not subject to customs inspection, except for cases of revealing signs of a risk of violation of customs legislation. At the same time, the exporter is responsible for the accuracy of the information contained in the documents, as well as the illegal movement of goods across the customs border of the Republic of Uzbekistan;

business entities may carry out construction and installation work on the construction of light structures on the land plots allocated to them for the construction of infrastructure facilities for irrigation, procurement and storage of fruits and vegetables directly in the places of its production.

2. The State Committee for Land Resources, Geodesy, Cartography and the State Cadastre, together with the Ministry of Agriculture, within a month should submit to the Cabinet of Ministers of the Republic of Uzbekistan a draft Regulation on the procedure for constructing light structures on land plots provided to business entities for irrigation, harvesting and storage of fruits and vegetables directly in the places of their production.

The Ministry for the Development of Information Technologies and Communications, together with the State Customs Committee of the Republic of Uzbekistan, until January 1, 2019, shall ensure the improvement of the Unified Electronic Information System for Foreign Trade Operations taking into account the requirements of paragraph 1 of this resolution.

3. To establish that fruit and vegetable exporters are responsible for providing reliable state data to the authorized state bodies in the accompanying documents on actually performed export operations on fruit and vegetable products, as well as violating the terms of receipt of proceeds from the export of fruit and vegetable products defined by the Cabinet of Ministers of the Republic of Uzbekistan.

4. To entrust the Ministry of Foreign Trade of the Republic of Uzbekistan with the following additional functions:

coordination of activities in the field of exports of fruits and vegetables;

providing practical assistance in the implementation of the export of fruits and vegetables by searching for potential partners, creating conditions for entering traditional and new sales markets, as well as providing, if necessary, methodological support for the execution of the export contract;

study on a systematic basis of the price situation for fruits and vegetables in foreign markets, including monthly meetings, visits to the regions, with producers and exporters of fruits and vegetables, as well as organizing the publication of research results, including information about the level of export prices for fruits and vegetables
on its official website and in other media;

providing on a monthly basis to exporters of fruits and vegetables the results of analysis and forecasts for the main sales markets, in particular, information on changes in price conditions, shipping volumes by destination and technical requirements when importing fruits and vegetables by posting on its official website and in other mass media information.

5. Chamber of Commerce and Industry, Ministry of Justice, Commissioner under the President of the Republic of Uzbekistan to protect the rights and legitimate interests of business entities in the two-week period to assist exporters and producers of fruits and vegetables in the formation of the Association of Exporters of fruits and vegetables of Uzbekistan.

6. The Ministry for the Development of Information Technologies and Communications together with the Ministry of Foreign Trade, the Council of Farmers, Dehkan Farms and Owners of Household Lands of Uzbekistan and the Ministry of Agriculture of the Republic of Uzbekistan before March 1, 2019 to develop and launch the Information Portal of horticultural products exporters on the Internet for account of the Information and Communication Technologies Development Fund, integrated with the electronic trading platform “TradeUzbekistan.com”, informational with Stem the State Tax Committee and the State Customs Committee of the Republic of Uzbekistan, including:

contains information on producers and exporters of fruits and vegetables, potential importers, types and volumes of export-oriented fresh, dried and processed fruits and vegetables, suppliers of seedlings, seeds and fertilizers for fruits and vegetables;

enables to track in real time all stages of the export process, as well as data on the exported fruits and vegetables by type, volume, amount and regions of its cultivation.

7. The Ministry of Agriculture, the Ministry of Foreign Trade, the State Customs Committee, the State Tax Committee, the State Plant Quarantine Inspectorate under the Cabinet of Ministers of the Republic of Uzbekistan, and other responsible ministries and departments ensure that the necessary data are timely added to the Information Portal of Fruit and Vegetables Exporters.

The Ministry of Foreign Trade in cooperation with the Ministry for the Development of Information Technologies and Communications of the Republic of Uzbekistan:

monitors the timely submission by relevant ministries and departments of relevant data to the Information Portal of exporters of fruits and vegetables;

on an ongoing basis takes measures to improve, ensure the smooth operation and information security of the Information Portal of exporters of fruits and vegetables.

8. Strictly warn the chairman of the Council of Ministers of the Republic of Karakalpakstan, khokims of regions, districts and cities, heads of territorial divisions of state bodies about personal responsibility for preventing the export of fruit and vegetable products on the basis of the territorial affiliation of the exporter.

9. The Ministry of Foreign Trade, jointly with the Ministry of Foreign Affairs of the Republic of Uzbekistan, should hold talks with leading foreign companies before January 1, 2019 and make concrete proposals for launching a pilot project to create trading platforms in the country and abroad with modern transport and logistics complexes: hubs, including on the terms of public-private partnership, for the implementation of domestic fruits and vegetables.

10. The Council of Ministers of the Republic of Karakalpakstan, regional hokimiyats together with the Ministry of Agriculture and the Ministry of Economy of the Republic of Uzbekistan according to the results of 2018, in the framework of optimization of the sown areas, should submit to the Cabinet of Ministers of the Republic of Uzbekistan focused lists of created clusters intended for production, harvesting, sorting, sizing, packaging and export directions for fruits and vegetables, including on the basis of land plots optimized by reducing the acreage for cotton nick and cereals.

The Ministry of Agriculture of the Republic of Uzbekistan should carry out an in-depth analysis of the status of the cluster system for growing fruit and vegetable products in the country, including taking into account the experience of leading foreign countries, following which, before December 1, 2019, submit proposals to the Administration of the President of the Republic of Uzbekistan to eliminate existing barriers in the effective functioning of clusters and further improvement of this sphere.

11. Agency "Uzstandart" in cooperation with:

The Ministry of Foreign Affairs of the Republic of Uzbekistan in three months should establish cooperation with internationally recognized organizations for certification of compliance with the requirements of the standards of "Global GAP", "Halal" and "Organic";

The Ministry of Agriculture of the Republic of Uzbekistan and the UzbekOzikOvkatHolding Holding Company, by February 1, 2019, submit a draft government decision on the further development of the production of organic and other products that meet the requirements of international standards;

The Ministry of Agriculture and the Ministry of Health of the Republic of Uzbekistan before March 1, 2019 should organize the training of specialists in certification of domestic enterprises producing fruit and vegetable products for compliance with the requirements of the Global GAP, Halal and Organic standards.

12. O'zbekiston Temir Yo'llari JSC (Railways) and O'zbekiston Havo Yo'llari NJSC (Airways) should take measures to introduce modern logistic management mechanisms to promote the export of fruits and vegetables, including:

a) O'zbekiston Temir Yo'llari JSC until January 1, 2019 should:

organize at the stations of departure the work on registration of railway documents on the export of fruits and vegetables on the principle of "one window";

revise tariffs and services when shipping and loading fruits and vegetables to simplify them, taking into account the specifics of products;

develop and implement a mechanism for transferring information at the request of shippers and cargo owners on the timing of cargo delivery and locations of freight wagons en route;

introduce a procedure for allocating wagons for exporters of fruits and vegetables in a period not exceeding three days from the date of receipt of the corresponding application;

b) by October 1, 2019, Uzbekistan Airways should re-equip the temporary storage of fruit and vegetable products with modern refrigeration equipment and scanning devices that meet international standards for packaging on pallets and ensure their throughput.

13. The Prosecutor General's Office, together with the Ministry of Justice of the Republic of Uzbekistan, in a two-month period, will provide a critical study of the activities of UzAgroExport JSC with the introduction of specific proposals for further improvement of the company's activities.

14. The Cabinet of Ministers of the Republic of Uzbekistan shall ensure:

approval of the updated Regulations on the procedure for export of fruits and vegetables within two weeks, taking into account the requirements of this decree, including the procedure for maintaining the register of unfair exporters of fruits and vegetables;

by January 1, 2019, elaborate the issue of education in the border areas of the country of special zones for exporters of fruits and vegetables with a modern production, engineering and communications, road and transport, social infrastructure, as well as logistics services and execution of necessary documents for the export of fruits and vegetables according to the principle "one window";

by January 1, 2019, jointly with the Central Bank of the Republic of Uzbekistan, study of the introduction of a mechanism for issuing credit funds by commercial banks for exporters and producers of fruits and vegetables in accordance with warehouse certificates issued by warehouses;

by February 1, 2019, in conjunction with the Ministry of Foreign Affairs and the Ministry of Foreign Trade of the Republic of Uzbekistan, study the real situation with the sale of fruits and vegetables abroad, the unfavorable conditions for exporters, including through dialogue with them;

by March 1, 2019, elaboration of a study on specific proposals for eliminating unfavorable conditions for exporters and submitting them to the Administration of the President of the Republic of Uzbekistan;

by March 1, 2019 approval of the Regulations on the maintenance of the Information Portal of exporters of fruits and vegetables.

15. Establish personal responsibility of:

Deputy Prime Minister of the Republic of Uzbekistan (Otazhonov) - for the identification and elimination of systemic problems that impede the accelerated development of the industry and the stable functioning of fruit and vegetable exporters, the development and introduction of proposals for further improvement of legislation in this area;

Deputy Prime Minister of the Republic of Uzbekistan (Mirzayev) - for ensuring the production of competitive fruit and vegetable products, as well as diversification of fruit and vegetable exports;

Minister of Foreign Trade of the Republic of Uzbekistan (Khodzhaev) - for assisting exporters of fruits and vegetables in promoting domestic fruits and vegetables to foreign markets, as well as increasing the export potential of the country;

Minister of Agriculture of the Republic of Uzbekistan (Yusupov) - for ensuring the increase in the volume of cultivation and export of fruits and vegetables with the rational use of natural resources and the introduction of innovative technologies, including the use of intensive cultivation technologies;

Chairman of the State Customs Committee of the Republic of Uzbekistan (Azimov) - for ensuring timely customs clearance of exported fruit and vegetable products, as well as maintaining a register of unfair fruit and vegetable exporters;

Head of the State Plant Quarantine Inspectorate under the Cabinet of Ministers of the Republic of Uzbekistan (Irgashev) - for ensuring timely quarantine inspection and laboratory expertise of exported fruit and vegetable products;

heads of JSC “Uzbekistan Temir Yollari” (Sagdullaev) and NAK “Uzbekistan Havo Yullari” (Khakimov) - for the creation of infrastructure meeting world standards to ensure timely and high-quality transportation of fruits and vegetables abroad;

Chairman of the Council of Ministers of the Republic of Karakalpakstan and regional khokims - for ensuring effective cooperation between producers and exporters of fruits and vegetables, assistance in organizing a cluster system for the production, harvesting, sorting, sizing, packaging and exporting fruits and vegetables.

16. The General Prosecutor's Office of the Republic of Uzbekistan to carry out systematic supervision over the fulfillment of the requirements of this resolution, ensuring the application of strict liability measures to the guilty parties.

17. The Ministry of Foreign Trade of the Republic of Uzbekistan, together with other interested ministries and departments within a month:

make proposals to the Cabinet of Ministers of the Republic of Uzbekistan on amendments and additions to the legislation arising from this resolution;

bring the adopted by them legal acts in accordance with this resolution.

18. The control over the execution of this resolution shall be entrusted to the head of the Presidential Administration of the Republic of Uzbekistan Z.Sh. Nizomiddinov, First Deputy Advisor to the President of the Republic of Uzbekistan Mavlonov B.M., Deputy Prime Ministers of the Republic of Uzbekistan Otazhonov N.S. and Mirzaev Z.T.
